This is an application seeking withdrawal of the amount of 50% back-wages directed by the School Tribunal. 2] Shri Dharmadhikari, who appears on behalf of petitioner has serious objection to permitting the respondent 1 to withdraw the amount.

3] However, in view of the fact that the order of reinstatement is stayed by this Court, it would be just and proper to permit respondent 1 to withdraw the 50% of the amount deposited in this Court subject to furnishing an undertaking that if respondent 1 is directed to or is otherwise required to refund the amount withdrawn, the same shall be done within four weeks of the decision in the writ petition along with the prevalent interest of rate as is applicable to fixed deposit.
