IN THE HIGH COURT OF JUDICATURE AT BOMBAY,
NAGPUR BENCH, NAGPUR.
CRIMINAL APPLICATION NO.89 OF 2024 (Umakant Kunjilal @ Aniket Mishra Vs. State of Maharashtra) -------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Court's or Judge's Order Coram, appearances, Court's Orders or directions and Registrar's order --------------------------------------------------------------------------------------------------------- Mr. P.V. Navlani, Advocate for the applicant. Ms M.A. Barabade, APP for the State.
CORAM:- URMILA JOSHI-PHALKE, J.
DATED :- AUGUST 16, 2024 By this application, the applicant is seeking modification of condition which is imposed by this Court while allowing the bail application of the applicant in Criminal Application (BA) No.982/2023. By the said order, the applicant was directed to attend the Gadge Nagar police station twice in a month and the investigating officer shall record his presence. 2.
Learned Counsel for the applicant submitted that the applicant is resident of Delhi and he has to travel twice in a month to attend the said police station. Now, investigation is completed and charge-sheet is filed, so his attendance at police station is not required. 3.
Learned APP strongly opposed the application and submitted that as the applicant is resident of Delhi, it would be difficult to secure his presence for the purpose of trial, and therefore, that condition was imposed. Hence, the application is devoid of merits and liable to be rejected.
64.appln.89.24.odt 4.
I have heard learned Counsel for both the parties. Perused the earlier order passed by this Court. Admittedly, the applicant is the resident of Delhi and to secure his presence that condition was imposed. 5.
In view of that, the condition is modified to the extent that the applicant shall attend the Gadge Nagar police station once in a month i.e. 15th day of every month and the Investigating Officer shall record his presence, till the culmination of the trial.
6.
The application is disposed of.
