Apprehending arrest in connection with Crime No.1086/2017 registered against the applicant and his father for the offence punishable under Sections 65(e) and 83 of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code, the applicant seeks pre-arrest bail.

According to the investigating agency, liquor worth Rs.1,27,000/- is seized from the house where both the accused are residing.

The application is opposed on the ground that the investigation is in progress and custody of applicant is required for investigation. It is further submitted that earlier also crime No.6321/2015 is registered against the applicant for similar offence and this shows that the applicant has the tendency to repeat the offence.

2 aba553.17 The learned Advocate for the applicant has submitted that father of the applicant is released on bail as per the order passed by the Sessions Court. It is submitted that the stock of liquor is seized and though the non-applicant is opposing the application on the ground that custody of applicant is required for further investigation, it is not pointed out for what purpose custody of applicant is required.

Hence the following order is passed:

In the event of arrest in connection with Crime No.1086/2017 registered by the non-applicant, the applicant be released on bail on furnishing cash security of Rs.25,000/- (Rs. Twenty Five Thousand) and one solvent surety in the like amount.

The application is allowed in the above terms. JUDGE Tambaskar.
