DATE : September 21, 2016 There is nothing on record to show that ailment of mother of petitioner is at advance stage warranting treatment at Mumbai only. Certificate dated 07/03/2016 issued by Kolte Hospital, Kudal advises further examination such as TMT, echocardiography and if necessary angiography. The tests could have been performed even at district place. Earlier certificate issued by Medical Officer, Group-A, Primary Health Center, Kadawal, Tal. Kudal, Dist. Sindhudurg declares mother unfit in bodily health. Under which provision such a declaration has been made is not apparent.
We find no case is made out warranting any interference in order rejecting parole leave to the petitioner.
2/3 Criminal writ petition is therefore rejected. Any further medical certificate produced by petitioner shall expressly mention and indicate knowledge to the doctor issuing it that the same would be presented to this Court and used for seeking parole.
