We do not find issue involved in the present petition has element of public interest for the reasons that the grievance made by the petitioner is that on a land owned by a Trust, the Corporation, by removing the huts, on such land constructed the Samaj Bhavan. The Trust has not filed any petition or raised any grievance. If the land is owned by the Trust and the Trust has not raised any grievance about the construction of Samaj Bhavan by the Municipal Corporation, we do not treat this petition as public interest litigation. 2.

Accordingly, the writ petition is disposed of, with liberty to the petitioner to file appropriate proceedings as permissible under the law, if he so desire.
