IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

NAGPUR BENCH : NAGPUR.

Contempt Petition (cp) No. 254 of 2015 (in Writ Petition (wp) No. 2048/12 [D]) Raju Madan Ingle v.

S.R. Dardar, Div. Dy. Direc. Of Agri., Krushi Sankul, Tapowan, Amravati Division, Amravati. ------------------------------------------------------------------------------------------------------------------------ Office Notes, Office Memoranda of Coram Court's or Judge's orders appearances, Court's orders or directions and Registrar's orders.

------------------------------------------------------------------------------------------------------------------------ Mr. A.P. Kalmegh Advocate for the Petitioner. Mr. Nitin Rode, AGP, for the respondent.

....

Coram : Smt. Vasanti A. Naik & V.M. Deshpande, JJ.

Date : 7th March, 2016.

By this contempt petition, the petitioner seeks action against the respondent for willful disobedience of the order dated 07.8.2012 passed by this Court in W.P. No. 2048/12. It is stated that though this Court had directed that the appointment of the petitioner should not be disturbed till his caste claim is verified, the respondent has failed to release the salary in favour of the petitioner from January, 2015.

0703cp254.15 Shri Rode, the learned Asstt. Govt. Pleader, on behalf of the respondent states, on the basis of the affidavit filed on behalf of the respondent on 23.2.2016, that the arrears of salary have been released in favour of the petitioner till 15.12.2015. It is stated that the salary payable to the petitioner would be released regularly after 15.12.2015 till the Caste Scrutiny Committee decides the caste claim of the petitioner.

In view of this statement made by the learned Asstt. Govt. Pleader, it appears that it would not be necessary to proceed with the contempt petition any longer. Hence, we dispose of the contempt petition in the aforesaid set of facts, with no order as to costs.
