Learned counsel for respondent no. 2 submits that the petitioners, by taking advantage of pendency of petition, are not releasing the terminal benefits to the respondent no. 2, to which, learned counsel for petitioners submits that the enquiry as regards financial defalcation and misappropriation is pending against the respondent no. 2. Learned counsel for respondent no. 2, however, submits, on instructions, that no such enquiry is pending. 3.
Considering the submissions made by the parties, the petition is disposed of as rendered infructuous. The petitioners shall release the terminal benefits to respondent no. 2, if there is no legal impediment. (Anil L. Pansare, J.) wasnik
