By this petition, the petitioner has sought a direction to the respondent to take a decision in the matter of refund of 25% amount deposited by the petitioner during the auction of the sand ghat. Shri Palshikar, learned Assistant Government Pleader states by referring to the affidavit in reply that the representation of the petitioner has been decided by an order dated 29-3-2014 which is annexed as Annexure R-1 to the reply. It is stated that the cause for filing the writ petition would not survive in view of the decision rendered by the respondent no. 1.

Shri Kukday, learned counsel for the petitioner states that the said decision was not conveyed to .....2/-

2 wp5194.15.odt the petitioner and the petitioner desires to take appropriate steps to challenge the said decision. Since the purpose of filing the writ petition stands served in view of the decision rendered by the respondent no. 1, we dispose of the writ petition with no order as to costs.

The petitioner is, however, free to challenge the decision of the State Government in appropriate proceedings.

Order accordingly.
