DATED : 24-2 -202 We indicated to learned counsel Mr. Patre that prima facie we find that the State is alive to its duty of ensuring that action is required to be taken against illegal sand excavation.

We have perused the affidavit in response and are further prima facie satisfied that the State is, as a fact, taking appropriate action not only against non-stake actors but also against the Government Officer/s who may be responsible.

We further find that the grievance, if at all, there is surviving, which is agitated, does not involve any individual or direct right of the petitioner.

At this stage, learned counsel for the petitioner Mr. Patre seeks leave to withdraw the petition with liberty to take appropriate steps.
