The applicant - original plaintiff is seeking condonation of delay of 169 days. The justification pleaded inter alia in paragraph 3 is that due to old age and ill-health the appeal could not be preferred within limitation. 2] Although Shri Ghate strongly objects to the prayer for condonation of delay, in view of the reasons pleaded in support of the application, the delay is condoned.

3] The learned counsel for the appellant to supply copy of the memo of appeal to Shri Ghate.

4] The learned counsel for the applicant shall further place on record copies of the deposition, if she intends to rely on the evidence at the time of hearing on the admission.
