This is an application for permission to withdraw the amount of compensation deposited by the appellant. 2.

Learned Advocate for applicant/respondent No.1 submits that respondent No.1 is the land owner, whose land was acquired and he is entitled for withdrawal of the amount of compensation deposited by the appellant. It is submitted that, in identical matters arising from the same project, this Court has permitted the claimants therein to withdraw the amount, which was deposited by the acquiring body. It is pointed out that, in those cases, 60% amount was deposited and the

2 63. CAF 2200 of 2025.odt claimants have withdrawn the entire 60% amount. Learned Advocate for the appellant does not dispute the position. 3.

Having regard to the facts of this case, the applicant/respondent No.1 are entitled to withdraw 60% of the entire amount along with accrued interest, subject to furnishing an usual undertaking to the Registrar (Judicial).
