Considering the facts on record and the amount involved, the respondent No.1/claimant is permitted to withdraw the amount deposited by the appellant on furnishing undertaking to the satisfaction of the learned Registrar (Judicial) of this Court stating that if it is found that the claimant is not entitled for the amount withdrawn by him, he will redeposit the amount with interest as may be determined by this Court, within two months.

The civil application is allowed in the above terms.
