Applicants/respondent Nos. 1 to 5 and legal heirs of respondent No.1 have filed this application to permit them to withdraw the amount of compensation deposited by the appellant, for which learned counsel for the appellant has given no objection. 3.

Having considered the reasons disclosed in the application, as well as no objection of the learned counsel for the appellant, the application is allowed as prayed. The applicants are permitted to withdraw the entire compensation amount along with interest accrued thereon on a usual undertaking.

It appears that during the pendency of the reference proceedings, original land owner Anjanabai expired and therefore, her legal heirs, i.e. applicant Nos. 1 to 5, were brought on record. Having considered the said fact, it would be appropriate to transmit the said amount in equal proportion to the bank account of applicants, on the usual undertaking and their furnishing of bank account details to the Registry.

As such, the Registrar (J) is directed to transfer the amount along with interest accrued thereon to the respective bank accounts of the applicants, in equal proportion, on their furnishing bank account details and usual undertaking to the Registry. (ABHAY J. MANTRI, J.) Belkhede
