DATED : 12/03/2024 The petitioner and respondent No.3 have jointly filed a settlement pursis dated 09/02/2024 signed by petitioner and respondent No.3 as well as their respective counsel. It is stated in the settlement pursis that the respondent No.3 is ready and willing to submit fresh proposal of approval along with all necessary documents, seeking approval to the appointment of petitioner as a Shikshan Sewak initially for three years from the date of her appointment and thereafter onward, to the respondent No.2 i.e. Education Officer (Secondary), Zilla Parishad, Wardha within 10 days from the date of order. It is further stated that, thereafter proposal for absorption of the petitioner in any other school, along with service book recording required entries from the date of appointment till date and all necessary documents, since post of Assistant Teacher is not presently vacant in the schools run by the

2 911 wp 4960-2021 respondent No.3 Management, shall be submitted within 10 days to the respondent No.2.

The petitioner at the same time agreed not to make any monetary claim from the respondent Nos.1 and 2 i.e. State of Maharashtra through its Secretary, Department of Secondary and Higher Secondary Education and the Education Officer (Secondary) Zilla Parishad, Wardha as well as from the respondent No.3 i.e. Saraswati Mata Vidya Prasarak Mandal, Thanegaon, till her absorption. 3.

The respondent No.2 Education Officer (Secondary) Zilla Parishad, Wardha has filed a separate pursis dated 15/01/2024, in light of order dated 24/07/2023 passed in Writ Petition No.1158/2020 and submits that in case a fresh proposal is submitted by the respondent No.3 Management before the Education Officer, (Secondary) Zilla Parishad, Wardha, the same will be decided within stipulated period.

In light of above, both the pursis namely, joint settlement pursis of the petitioner and respondent No.3 Management dated 09/02/2024 and the purisis dated 15/02/2024, filed by the respondent No.2, the Writ Petition is disposed of.

Parties have directed to act upon their statement made in the respective pursis.

The respondent No.2 Education Officer (Secondary), Zilla Parishad, Wardha is directed to decide the proposal as regards grant of approval to the
