Kanungo, advocate for the applicant submits that because of the observations in the judgment given by this Court on 27th July, 2015 the jurisdiction of the learned Arbitrator would be limited and all the contentions raised by the applicant will not be considered by the learned Arbitrator. In my view, the apprehension of the applicant is premature.

Shri K.P. Kanungo, advocate for the applicant, on instructions, seeks permission to withdraw the miscellaneous civil application with liberty to raise the contentions at appropriate stage, if required. The application is disposed of as withdrawn with liberty as prayed for.
