This petition takes exception to the order dated 26.04.2023 passed by the learned Civil Judge Senior Division, Akola below Exhibit 50 in Special Civil Suit No.11/2019.

By the order impugned, the learned trial Court has rejected the application filed by the present petitioner/defendant to de-exhibit certain documents namely Will and relinquishment deed. 3.

I have heard the learned counsel for the petitioner.

At this stage, I am not inclined to entertain the present petition. However, it would be Prity

2 / 2 2.wp5154.2024 open to the petitioner to raise all the contentions which are sought to be raised in the present petition in relation to the documents in question at the time of the final hearing of the suit, including the contentions in respect of inadmissibility of the said documents.

The petition is disposed of in aforesaid terms.
