The appeal is admitted. I have gone through the suicide note, which has been reproduced in the judgment (internal pages47 and 48). I am of the view that this suicide note, which apparently form the basis for holding the appellants guilty of the offence punishable under Section 306 of the Indian Penal Code itself makes out an arguable case for the appellants. Hence, the order.

The application is allowed. Substantive sentences of imprisonments imposed upon both the applicants are hereby suspended until final disposal of the appeal and till that time the applicants/appellants be released on bail on each of them furnishing a P. R. Bond in the sum of Rs.15,000/- together with one solvent surety in the like amount on the condition that the appellants shall pay fine amount, if not paid. JUDGE wwl
