DATED : SEPEMBER 7, 2016 Heard learned Counsel for the applicant and learned A.P.P. for the State. Perused the first information report and other documents filed along with this application and also the reply of the prosecution, which is taken on record.
Although, this applicant has been identified, the identification was done when the applicant was in police custody and at the police station. Therefore, such identification would not be of any assistance to the prosecution. Then, no recovery of any incriminating articles from this applicant has been made. In the circumstances, I am inclined to grant this application.
The application is allowed and it is directed that the applicant be released on bail on his furnishing a P. R. Bond in the sum of Rs.20,000/- with one solvent surety in the like amount on the conditions that he shall regularly attend the Court proceedings on the dates fixed in the matter, shall cooperate with the trial Court in expeditious disposal of the case and shall not tamper with the prosecution witnesses, in any manner.
