By this application, the respondent No.1 has sought withdrawal of compensation deposited by the appellant as per the judgment and award dated 05.11.2012 in the Land Acquisition Case No.205 of 2005.

Having considered the reasons stated in the application, 75 % of the compensation along with interest accrued thereon, is ordered to be paid to respondent No.1, subject to filing an undertaking that the amount will be refunded in the event the appellant succeeds in the appeal.

The application stands disposed of.

Registry to disburse the amount expeditiously after verifying all the relevant documents.
