By preferring this application, the appellant is seeking condonation of delay of 15 days which is caused in preferring the appeal as the learned Special Judge has rejected the application of the present appellant for bail.

It is submitted by the learned Counsel for the appellant that the appellant is behind bar since the date of arrest. There is nobody to look after his defence and therefore, he could not approach to the Counsel. Moreover, his financial condition is not also good and therefore, fifteen days delay is caused in preferring the appeal.

Learned APP strongly opposed the said application. Considering the reason mentioned in the application which appears to be just and reasonable

(2) 20.appa.786.2024 cause for condonation of delay. Moreover, the liberal approach is to be adopted while considering the delay application. In view of that, the application is allowed. The delay caused in preferring the appeal is hereby condoned.

Criminal application is disposed of.

CRIMINAL A PPEAL STAMP NO.6740 OF 2024 1.

Appeal be registered.

Issue notice to the respondent No.2, returnable after two weeks.

Respondent No.2 be intimated through Police Station Officer, Police Station, Arvi, Taluka Arvi, District Wardha.

Learned APP waives notice for the State and seeks time to file reply.

Stand over after two weeks.
