In this writ petition, the order below Exh.115 dated 07.10.2021 passed by the Joint 7th Jt. Civil Judge Sr. Dn., Nagpur in Spl C.S. No.1221 of 2008 is under challenge, whereby, the learned trial Court rejected the application filed by the petitioner for admitting the document.

Admittedly, the application was moved after the trial was concluded and case was fixed for final argument. The trial was concluded long back on 15.02.2020 after recording the evidence of both the parties. 4.

Thus, there is no question of admissibility of a document at a stage when the matter was fixed for hearing, C.L.Dhakate

904..odt therefore, the learned trial Court has recorded the reasons and observed that no ground or cause is put-forth to substantiate why such notice was raised at the belated stage. As I do not find any perversity or illegality in the said order. Accordingly, the writ petition is dismissed.
