The present application is filed by respondent no. 1/applicant for permission to withdraw the amount deposited by the appellant.

The learned counsel appearing for the appellant submits that in similar matter, 50% of the amount is allowed to be withdrawn. In view thereof, he has no objection for allowing the applicant to withdraw 50% of amount.

By this application, it is also brought on record that respondent no. 1/applicant is only the legal heir of respondent no. 3 who has expired on 08/12/2012. The applicant has also placed on record the legal heir certificate issued on 09/12/2019 by the learned Civil Judge, Junior Division, Dharni, Distt. Amaravati.

In view of no objection, the application is partly allowed. 5.

The applicant/respondent no. 1 is allowed to withdraw 50% of the amount deposited by the appellant. 6.

The Registry is directed to disburse 50% of the amount along with interest in the account of respondent no. 1 after verifying the bank details.

FIRST APPEAL NO. 1285 OF 2018 At the joint request, place this matter along with connected First Appeal No. 1263/2018, First Appeal No. 1284/2018, First Appeal No. 1286/2018 before National Lok Adalat scheduled to be held on 13/08/2022.
