2) Ms. Kulkarni, learned Assistant Government Pleader for respondents points out that allotment of sand ghat for the year 2002-03 forms subject matter of challenge and hence, petition has become infructuous. 3) We have perused papers. We find that petition was dismissed in default on 26/3/2004 and then after restoration was admitted for final hearing on 13/12/2004. On that day, interim stay in terms of prayer clause (C) was granted. As per that interim order, additional royalty amount demanded from petitioner was stayed.

4) In this situation, as nobody appears for petitioner, we dismiss the writ petition for want of prosecution. Rule is discharged. No costs.
