This is a second bail application filed on behalf of the present applicant. The first bail application, which was registered as Criminal Application [BA] No. 377 of 2015 was dismissed on its merit by this Court [Coram P.B. Varale, J.] on 22nd July, 2015.

According to the learned counsel for the applicant, after passing of the aforesaid order by this Court, the co-accused, who is placed on the same footing with that of the present applicant, has filed an application for regular bail before the court below and the Court below has granted the bail in favour of the said co-accused. In that view of the matter, he submits that he wishes to withdraw the present application to enable the present applicant to file a bail application afresh before the learned Trial Court.

Since the present applicant is claiming parity with the co-accused, who is granted bail by the court below, it would be expedient in the interest of justice to allow the applicant to file a bail application afresh and the learned Trial Court to consider such application in accordance with law.

Application is disposed of.
