JULY 23, 2025 By present application, the applicant/ appellant is seeking to condone delay of 260 days in filing appeal against order of conviction, by which he has been convicted under Section 302 of the Indian Penal Code, 1860, and sentenced to undergo life imprisonment. 2] The learned Counsel for the applicant submits that the applicant is in jail and has restrictions to collect documents. He is a labour and unable to engage Counsel of his choice to present the appeal. Accordingly, he moved the Legal Services Authority to appoint a Counsel.

3] The learned A.P.P. has opposed the application on the count that the reasons, so assigned, are not sufficient.

4] We, however, are of the view that the reasons, so assigned, are justified. The applicant is in jail and definitely has restrictions to collect documents,

907-APPA-617-2025 appoint Counsel and give instructions, most importantly, he is a labour and unable to engage Counsel of his choice. 5] In view of above, and for the reasons set out in the application, the same is allowed. Delay of 260 days in filing appeal stands condoned. Appeal be registered and processed as per Rules.

6] The application is disposed of.
