Perusal of the judgment and order passed by the learned Sessions Judge would reveal that it is case of absolutely no evidence. There is not a single witness who has supported the prosecution case.
Scope of interference in appeal is very limited.
2-Cri.APPA-554-16 2/2 Unless the finding as recorded by the learned Sessions Judge is found to be perverse or improbable, an interference would not be warranted. This is not a fit case warranting interference. Hence the appeal stands dismissed.
Fees of the learned counsel appointed is quantified at Rs.1500/-.
