Shri P.V. Dandwate, Advocate for the petitioner. Shri A.S. Fulzele, Additional Government Pleader for the respondents/ State. CORAM : A. S. CHANDURKAR AND ANIL L. PANSARE , JJ.

D ATE : DECEMBER 19 , 202 2 .

The petitioner seeks issuance of caste validity certificate. He had earlier approached this Court by filing Writ Petition No. 1149/2022. By the order dated 4/5/2022, this Court granted liberty to the petitioner to make an application to the Scrutiny Committee to consider his application for issuance of validity certificate out of turn. Pursuant thereto, the petitioner has on 12/5/2022 made such an application praying for expeditious adjudication of the claim. Since no decision thereon has been taken, the present Writ Petition has been filed. This Court on 12/10/2022 while issuing notice had called upon the Scrutiny Committee to furnish the statistical data with regard to the pendency of the claims for scrutiny wherein this Court has directed expeditious disposal of the proceedings.

Today, the learned Additional Government Pleader has tendered a communication dated 1/12/2022 indicating those figures. The said communication is taken on record and marked 'A' for identification. We find that the petitioner pursuant to the liberty granted has approached the Scrutiny Committee with his request for expeditious consideration. It would be necessary for the Scrutiny Committee to take a decision either way on the said application.

Accordingly, the Writ Petition is disposed of by directing the Scrutiny Committee to decide the petitioner's application dated 12/5/2022 within a period of three weeks from receiving copy of this order. It is open for the Scrutiny Committee to consider the request made therein in accordance with law.
