Apprehending the arrest at the hands of police in connection with Crime No.85 of 2025 registered with Police Station Ajni, District Nagpur for the offence punishable under Sections 115(2), 351(3) and 85 of the Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961, the applicant approached this Court for grant of pre-arrest bail.

The crime is registered on the basis of report lodged by the wife of the present applicant on an allegation that her marriage was performed with the present applicant. The present applicant is residing in USA at Boston and she was subjected for the ill-treatment at the hands of the Kavita

2 / 2 14-aba 537-25 present applicant when she was residing along with him. On the basis of the said report, police have registered the crime against the present applicant.

Learned Counsel for the applicant submitted that as far as the allegations are concerned which are baseless and false. Even accepting the allegation as it is, his custodial interrogation is not required. In view of that, he be protected by granting ad-interim protection.

The applicant is staying in U.S.. His statement is recorded through video conferencing as per directions of this Court. The custody of this applicant is not required. Hence, the interim protection granted on 18/07/2025 needs to be protected on the same terms and conditions, except condition No. iv. Hence, the following order. i] The application is allowed.

ii] The order dated 18.07.2025 granting ad-interim anticipatory bail is confirmed.

iii] The applicant shall attend the case through V.C or physically, if the trial is commenced .

iv] The application stands disposed of.
