In view of notice for final disposal issued earlier, the learned counsel for the parties have been heard. The applicant seeks appointment of an Arbitrator to resolve the disputes that have arisen between the parties. The agreement between them and the existence of an arbitration clause is not in dispute.

By order dated 10.09.2018, a letter of disclosure was directed to be obtained from the Arbitrators proposed to be appointed. Accordingly, by communication dated 27.09.2018 it has been informed by Shri R.C. Chavan (Retired Judge of this Court) that there are no circumstances that would come in the way of the learned Arbitrator in adjudicating the dispute. Accordingly, Shri R.C. Chavan (Retired Judge of this Court) is appointed as Arbitrator to resolve the dispute between the parties. The parties shall deposit an amount of Rs.5,000/- each by way of security within a period of three weeks from today. The application is disposed of.
