The petition challenges the decision of respondent to hold two of the bidders qualified to bid in the tender process.

It is the contention of the petitioner that though the respondent was informed about their disqualification, the respondent rejected the objection raised by the petitioner and permitted the said bidders to participate in the tender process. Admittedly, any order passed by this Court in the present proceedings will adversely affect the interest of those two bidders who have not been joined as party respondents to the present writ petition.

The petition is, therefore, rejected on the ground of non-joinder of the necessary party. JUDGE JUDGE halwai
