This is a successive bail application on the ground that as the main accused has released on bail, the applicant is entitled to release on bail.

He further submits that, the applicant is in jail from last one and half years and considering the period of incarceration, he may be released on bail.

After going through the charge-sheet, First Information Report and the statement of witnesses, it is apparent that, the offence is very serious and there is an ample incriminating material available on record against the

2.ba.785.23.odt applicant and considering the maximum punishment for the offence under Section 302 of the Indian Penal Code and the fact that, the earlier application was rejected on merit and there are no change in circumstances after rejection of the first application, the application is rejected.
