In view of the succession certificate proceedings pending before the Civil Judge Senior Division, Chandrapur, the learned Counsel for the petitioner, on instructions, seeks permission to withdraw the present writ petition with liberty to file afresh, if occasion arises on disposal of the succession certificate proceedings vide M.J.C. No.183/2021.

Permission is granted to withdraw the present petition with liberty as prayed for.

At this stage, the learned Counsel for the petitioner points out that the said proceedings vide M.J.C. No.183/2021 is pending since 2021 and the petitioner is not getting family pension. As such, she and her family is facing financial difficulties. She accordingly, prays for direction to the Civil Judge Senior Division, Chandrapur before whom such proceedings is pending to expedite the proceedings and decide the same at the earliest. 4.

We find substance in the prayer made by the learned Counsel for the petitioner.

Accordingly, we request the Civil Judge Senior Division, Chandrapur to decide the proceedings vide M.J.C. No.183/2021 expeditiously and in any case within a period of six months from today.
