The petitioner is aggrieved by non-consideration of his appeal filed under provisions of Section 18(4) of the Maharashtra Money-Lending (Regulation) Act, 2014. Said appeal was not considered on account of nonavailability of the Competent Authority. Shri P. S. Kshirsagar, learned counsel for respondent No.1 states that the Divisional Joint Registrar, Money-Lending as well as Divisional Joint Registrar, Co-operative Societies is now available for considering the appeal filed by the petitioner. Smt. H. Prabhu, learned Assistant Government Pleader for respondent Nos.2 to 4 does not dispute aforesaid aspect.
In view of aforesaid, the Divisional Joint Registrar, Money-Lending shall consider the appeal filed under the
23-WP-5274-15 2/2 said Act in accordance with law. The application for stay which is also pending shall also be decided in accordance with law. Till the application for stay is decided, the ad interim order granted on 14/09/2015 shall continue to operate. However, proceedings shall be decided in accordance with law without being influenced by continuation of interim relief. The parties undertake to appear before the State Authority on 11/01/2016 and said Authority shall decide the appeal within period of three months from said date. Rule is disposed of in aforesaid terms with no order as to costs.
