Mr. Gaikwad, learned counsel for the respondents opposed the Application on the ground that the reasons given are not satisfactory. Seen the reasons for condonation of delay. I am satisfied that sufficient grounds are made out for condoning the delay and hence the delay of 44 days deserves to be allowed,subject to the payment of costs. Hence the following order:

ORDER

The delay of 44 days in filing Second Appeal is condoned, subject to payment of costs of Rs. 500/- (five hundred) to be paid to the respondent.

Civil Application is allowed accordingly.
