He further prays for grant of liberty to file a fresh application, in case, there is no substantive progress in the trial, in near future. 2.

Permission to withdraw the application is granted with liberty to move a fresh, if there is no progress in trial in nine months.

The criminal application is disposed of as withdrawn.
