The learned Counsel for the appellant submits that the appellant is not responding to his calls as also the letters sent by him. A pursis to that effect has been filed on record. Accordingly, the learned Counsel seeks discharge.

2] Since letter has been issued by the learned Counsel to the appellant that he will be seeking discharge and since the appellant is not responding to the Counsel's calls, the request seeking discharge is allowed. The learned Counsel stands discharged.

3] It appears that the appellant is not interested in prosecuting the appeal.

4] The appeal is, therefore, dismissed under Order XLI Rule 17 read with Order XLII Rule 1 of the Code of Civil Procedure, 1908.

5] Copy of order be served upon the appellant for taking necessary steps, if so desired.
