Heard learned counsel for the petitioner.

In the present petition, a challenge is raised to the communication dated 18.11.2021 issued by the Joint Director of Vocational Education and Training, Nagpur Division, Nagpur, informing that the claim of the petitioners for appointment on compassionate ground cannot be considered as the deceased employee was working in a Grade Pay of Rs.4,400/-.

It is an admitted fact that the father of the petitioner no.2 died on 14.04.2017 and the communication rejecting the claim of the petitioner no.2 for appointment on compassionate ground was issued on 18.11.2021 and received by the petitioner no.2 on 25.11.2021. Despite the same, for last four years the petitioners remained silent and did not raise any grievance about the compassionate appointment. 4.
It is evident that from the date of death of the father of the petitioner no.2 and the date on which the present petition was filed, the period of eight years has been lapsed. Thus, huge period has been lapsed in between.

In the circumstances, considering the purpose of appointment on compassionate ground, which is not a right but it is for the purpose of sudden crisis occurring in the family either on account of death or medical invalidation of the bread winner while in service. The whole object of granting compassionate appointment by the employer being intended to enable the family members of the deceased or incapacitated employee to overcome the sudden financial crisis, the appointment on compassionate ground should be made and has to be made immediately to help the family in distress. 6.
The petitioner in this case has financially sustained for such a long period and did not approach this Court immediatel. As such considering the purpose and object of the compassionate appointment, this petition cannot be entertained.
