This appeal challenges the order dated 1.8.2015 passed by the District Judge, Bhandara, in Regular Civil Appeal No.114 of 2011. It is accompanied by an application for condonation of delay, which according to Mr. A.M. Quazi, learned counsel appearing on behalf of the appellants, comes to a delay of only two days while Mr. N.B. Kalwaghe, learned counsel appearing on behalf of the respondent no.1, submits that if the time period consumed in pendency of the appeal before the District Judge is taken into account, the period of delay comes to 231 days. Although objection is raised on behalf of the respondents, but, for the reasons stated in the application for condonation of delay, I find that the sufficient ground is made out and that the delay in filing of the instant appeal deserves to be condoned. Accordingly, delay is condoned and the appeal is taken up for hearing on merits.
