ATE : MARCH 05 , 2024 It is not in dispute that the amount to which the petitioner was entitled on his retirement as Headmaster on 30/06/2019 is paid on 10/01/2024.

2) Admittedly, the petitioner is entitled for interest on the delayed payment pursuant to the Notification dated 26/11/2008, issued by the Finance Department. 3) In this background, we deem it appropriate to dispose of the petition with directions to the respondent Education Officer to pay the interest to the petitioner on delayed payment for a period with effect from 30/06/2019 i.e. from the date of retirement till the date of payment i.e. 10/01/2024 @7.00%p.a.

4) Needless to state that in view of submissions made by the Assistant Government Pleader, we deem it appropriate to grant liberty to the respondent authorities to recover the amount KOLHE

2 937-wp 6611.2022.odt of interest from the employee, who was at fault in not processing the request of the petitioner for releasing his retirement/terminal benefits.

5) As such, the writ petition is disposed of in above terms.
