The applicant is seeking pre-arrest bail in Crime No.11 of 2022, dated 08.01.2020, registered with Police Station Khamgaon (City), District: Buldhana, for the offences punishable under Sections 409, 420, 468 and 471 of the Indian Penal Code.

It is the case of the prosecution that, by tampering the Government record for personal gain, the accused persons have committed alleged offence under Sections 409, 420, 468 and 471 of the Indian Penal Code. 4.

After going through the case diary and considering the material collected by the Investigation Officer against the applicant i.e. a statement of Circle Officer who has submitted the report which is the basis to register the offence, it can be seen that the applicant is not C.L.Dhakate

918.aba.666.2022.odt the main accused against whom serious allegations are made. Thus, considering the role attributed to the applicant, I am of the opinion that, his custodial interrogation is not necessary. Furthermore, there are no criminal antecedents against the applicant. Accordingly, I pass the following order:

a) The criminal application is allowed.

b) Order passed by this Court on 15.09.2022, granting ad-interim anticipatory bail, is confirmed with modification that the applicant shall attend the concerned Police Station as and when his presence is required.

c) The State is at liberty to apply for cancellation of bail, in case, breach of any condition or commission of similar offence.

The criminal application is disposed of accordingly.
