This is an application filed on behalf of the appellant, whose appeal was dismissed by judgment and order dated 10.07.2018 and he was granted two weeks time to surrender to serve out the remaining part of the sentence. By this application, a prayer is made for extension of time of two weeks to surrender on the basis of grounds stated in paragraph 3 of the application. This application is opposed on behalf of the respondent-C.B.I. It is contended that the appellant may abscond while making the aforesaid prayer for extension of time to surrender.
Heard Mr. Bramhe, learned counsel for the applicant/appellant and Mr. Khan along with Mrs. M.R. Chandurkar, Advocates represented the respondent-CBI. In the application, it is pointed out that there are some circumstances in the family of the appellant, which would require his presence with the family for a further period of two weeks. The learned counsel
APPA712-18.odt appearing for the applicant/appellant submits that the appellant undertakes to surrender within a period of two weeks in terms of the judgment and order dated 10.07.2018. In these circumstances, the apprehension expressed on behalf of the respondent-CBI that the appellant would abscond does not appear to be well founded. But, it is made clear that the appellant shall surrender in terms of judgment and order dated 10.07.2018 by 7.8.2018. It is made clear that no further prayer for extension of time to surrender shall be entertained by this Court. Application is disposed of. Ordinary copy of this order be supplied to the learned counsel for the applicant/appellant.
