By the present application, which is signed by counsel for both the parties, a request is made to pass necessary order as regards settlement deed and to dispose of the petition by quashing and setting aside the impugned order dated 23.06.2023 passed by respondent No.1, in Revision Application No. 24/2019, order dated 08.03.2019 passed by respondent No.2 in Appeal No.23/2018 and order dated 12.06.2018 passed by respondent No.3 in Application No.44/2017. By these orders, the respondents were pleased to cancel the sale deeds registered by respondent No.5 in favour of petitioner and directed to restore possession of the property to respondent No.5. 3.
The parties have settled the dispute amicably. It has been now decided that the petitioner shall pay to respondent No.5, an amount of Rs.7,50,000/- towards full and final settlement to retain the sale deed. Out of Rs.7,50,000/-, Rs.4,00,000/- is being paid by way of Demand Draft and is handed over to respondent No.5 today in
(2) 912wp5592.23 the Court. The remaining amount of Rs.3,50,000/- will be paid, if and when the criminal proceedings are completed. 4.
As such, in terms of settlement filed before the Court, the full and final amount viz. Rs.7,50,000/- is not mentioned. However, the parties who are present before the Court have made settlement through their counsel and accordingly the amount of Rs.7,50,000/- has been quantified and fixed as full and final settlement for retention of the sale deed.

The petition is accordingly disposed of in terms of what has been noted hereinabove as also in terms of settlement annexed with the application.

The impugned order dated 23.06.2023 passed by respondent No.1, in Revision Application No. 24/2019, order dated 08.03.2019 passed by respondent No.2 in Appeal No.23/2018 and order dated 12.06.2018 passed by respondent No.3 in Application No.44/2017 are quashed and set aside.

The application as well as the writ petition is disposed of. No order as to costs.
