DATE : October 09, 2018 By this application it is prayed that delay in filing the Second Appeal be condoned. It is submitted that initially the applicant had filed Writ Petition No.1216/2018 for challenging the order dated 03/01/2017 passed by the appellate Court refusing to condone delay. On 01/03/2018 the Writ Petition was disposed of and liberty was granted to file an appeal under Section 100 of Code of Civil Procedure, 1908. The Second Appeal has been filed on 10/04/2018. Considering the aforesaid facts and as there is no opposition to the prayer for condonation of delay, the application is allowed. The delay stands condoned. Civil Application is allowed and disposed of. JUDGE Asmita
