The applicant is seeking bail under Section 439 of the Code of Criminal Procedure in Crime No. 788 of 2022 registered with Police Station Awadhutwadi, Dist. Yavatmal for the offence punishable under Sections 143, 146, 147, 148, 149, 307, 323, 294, 506 of Indian Penal Code.

In this crime, accused no.4 has approached to this Court for grant of bail, whereas accused nos. 2, 3 and 8 are released on regular bail. Co-accused Ashutosh and accused no.16 were granted anticipatory bail. 3.

Considering the role of the present applicant and the role of the co-accused who have been SKNair

63-ba-1124-22.odt released on bail and considering the fact that the there are counter First Information Reports, and investigation is almost completed, I am of the opinion that further custody of the applicant is not necessary and he is entitled for grant of bail. Accordingly, I pass the following order.

i) The Criminal Application is allowed.

ii) It is directed that applicant shall be released on bail in Crime No.788 of 2022 registered with Police Station Awadhutwadi, Dist. Yavatmal for the offence punishable under Sections 143, 146, 147, 148, 149, 307, 323, 294, 506, on his furnishing P.R. Bond of Rs.25,000/- with a solvent surety in the like amount; iii) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence.

iv) Liberty is granted to the State to apply for cancellation of bail, in case, the applicant repeats the offence or commits any serious offence.
