Shukre, J Dated : April 27, 2017 After hearing this matter for some time, learned counsel for the applicant, on instructions, seeks leave of the Court to withdraw the Criminal Writ Petition with liberty to file a fresh application seeking discharge on merits of the case, barring the technical point of sanction. Leave with liberty, as prayed for, is granted. As regards the technical point of sanction, it is made clear, the petitioner shall have the liberty to raise that issue also at the time of conclusion of the trial, but not in the discharge application, if it is filed. Writ Petition is disposed of as such. Interim stay granted by this Court vide order dated 13th January 2017 shall continue till discharge application is filed or till 12th June 2017, whichever is earlier.
