DATE : AUGUST 16, 2017 Notice on the application is made returnable forthwith. Shri Joshi, learned counsel waives notice for the nonapplicant. While deciding Second Appeal No.279 of 2003 on 29/06/2017, the interim relief granted earlier was continued for a period of six weeks. By this application it is prayed that time of three months be granted to vacate the suit premises. Shri Joshi, learned counsel for the non-applicant does not oppose for grant of reasonable time.
Considering the facts of the case and as the applicant is shown to be eighty years of age, he is granted time till 15/11/2017 to vacate the suit premises. The applicant shall file undertaking to that effect in this Court within period of three weeks from today. Civil application is disposed of.
