Learned Counsel Mr. Deshpande waives service of notice for the respondent.

It is a common ground that pending the first appeal, the first appellate Court directed the appellant to pay occupation charges at the rate of Rs.1.50 lakhs per month. After disposal of the appeal, the said amount has not been paid to the respondent.

The appellant to clear the outstanding dues till the date at the same rate i.e. Rs.1.50 lakhs per month, within four weeks and also continue to pay occupation charges regularly. The respondent shall be at liberty to withdraw 50% of the amount deposited before the appellate Court.
