The mode of appointment of Arbitrator, as contemplated by clause 32 of the agreement of sale, has failed and, therefore, in terms of Section 10(2) of the Arbitration and Conciliation Act, the learned counsels appearing for the parties submit that the appointment of the sole Arbitrator is required to be made by this Court.

Both the learned counsels suggest the name of Shri K.J. Rohee, Retired High Court Judge, for being appointed as the Arbitrator to settle the disputes between the parties. Hence, Shri K.J. Rohee is appointed as the Arbitrator to settle the disputes between the parties.

The applicant to pay the process fee, as required.
