This is an application for grant of Pre-arrest bail. The applicant is apprehending his arrest in connection with Crime No. 1178/2017 registered with Police Station, Ramnagar, Dist. Chandrapur for the offences punishable under Sections, 365, 504, 323 read with Section 34 of Indian Penal Code.

Heard Shri S.V. Sirpurkar, learned counsel for the applicant and Shri M.J. Khan, learned Additional Public Prosecutor for the State and also perused the investigation papers.

The First Information Report is lodged by one Aruna Chitale wherein she has stated that there was a

2 ABA567.2017 matrimonial dispute between the applicant and his wife and for that reason, he came at her in-laws house on 23/07/2017 where the wife of the applicant was residing and during the course of the said meeting, the husband of the complainant tried to resolved the dispute in between the said couple due to which according to First Information Report the complainant's husband was assaulted by the applicant.

The injury report shows that there are abrasions on the body of the husband of the complainant. Looking to the nature of the accusations made in the First Information Report, I am of the view that the custodial interrogation of the present applicant is not necessary. However, the interest of the prosecution can be secured by directing the applicant to attend the police station. Hence the order:-

1] The application is allowed.

2] The applicant, in the event of arrest, in

3 ABA567.2017 connection with Crime No. 1178/2017 for the offences punishable under Sections 365, 504, 323 read with Section 34 of Indian Penal Code registered with Police Station Ramnagar, Dist. Chandrapur be released on bail on he executing a P.R. Bond of sum of Rs. 10,000/- with two solvent sureties in the like amount.

3] The applicant shall attend police station once in a week i.e. on every Sunday in between 3.00 P.M to 5.00 P.M till the filing of the Charge-sheet. 4] Application is allowed and disposed of.
