DATED : OCTOBER 10, 2019 At the outset Mr. Ghurde learned Additional Public Prosecutor for non applicant-State on the instructions from the investigating officer who is personally present in the Court makes statement that the trial is already commenced and today itself the case is fixed for recording of evidence.

Upon this Mr. Dhore the learned counsel for the applicant also admits the same and submits that he wishes to withdraw the present application with prayer to direct the learned Court below for early disposal of the trial. The application is disposed of as withdrawn.

The learned Additional Sessions Judge-12 before whom Special MPID Case.4/2019 is pending, shall decide it as early as possible not later than one year from the receipt of this order since the applicant is under trial prisoner. It is made clear that case of the present applicant was not heard on its own merits.
